Frequently asked questions
The questions EB-3 Skilled candidates and employers ask us most.
General
How is EB-3 Skilled different from Unskilled?
Skilled jobs require skill (≥2 years training/experience) plus English and credentials. Unskilled doesn’t. In return, skilled is charged Worldwide and is usually faster.
Can you guarantee a green card?
No one may guarantee outcomes. We follow the process with real jobs and licensed attorneys, but the final decision is the U.S. government’s.
How much does it cost?
Every case differs, so we don’t publish prices. The first consultation is free, if it’s a fit, we give a specific, milestone-based figure before you sign.
You have no office in Vietnam?
Our office is in Houston, we serve clients in Vietnam and across all 50 states via online meetings / Zalo. Most clients come through referrals and a trusted agency.
Candidates in Vietnam
What degree do I need?
At least a bachelor’s (a Vietnamese college diploma is often discounted), or equivalent experience matching the role. Degrees are run through a credential evaluation.
Do I keep working in Vietnam while I wait?
Yes. During PERM / the visa wait you keep living and working normally, nothing to do.
Can my family come?
Spouse and children under 21 come with you.
Students / OPT
OPT is ending and H-1B failed, now what?
EB-3 Skilled is a green-card route, not a lottery like H-1B. With a U.S. degree on OPT, this is often the fastest group.
EB-3 or study more to keep status?
Studying 4 more years can cost ~$80k. If you already qualify, EB-3 Skilled is a direct path, we’ll analyze your specific case.
Can I file I-485 in the U.S. right away?
It depends on which chart USCIS uses each month (Final Action vs Dates for Filing). We advise based on timing and your case.
What if my OPT expires mid-process?
EB-3 is a green-card track and does not by itself grant work authorization. You need to keep valid status (OPT/STEM OPT or another category) while you wait. Start early, before OPT ends, and the attorney advises on keeping status for your situation.
How long does it take?
No one can promise a timeline (it depends on PERM, USCIS, and the monthly Visa Bulletin). Most cases take years, not months. We give a realistic estimate for your case during the consultation.
Employers
What do we have to do?
You sponsor (petitioner) and sign filings. LLK + attorneys run PERM, recruitment and the I-140.
Is it safe under audit?
Yes, real people, real jobs, by-the-book PERM, licensed attorneys. Audit-ready for DOL/USCIS.
Will the hire stay?
They’re motivated to stay long-term, their green-card path is tied to the job.
